Please note this IR is specific to the employer's XCMG equipment. Findings related to other equipment brands will be documented in separate reports. To investigate allegations related to the employer's XCMG mobile elevating work platforms (MEWPs), I have obtained and analyzed relevant records and information, inspected equipment owned and sold by ANT Rentals Ltd, and liaised with and/or interviewed personnel who had information relevant to this matter. I have also obtained information from the manufacturer. ANT Rentals Ltd provided documentation indicating twenty-seven (27) XG4047DC MEWPs purchased from XCMG Canada Ltd were manufactured in 2024 (see IR202616635991A). However, information obtained during this investigation established that the MEWPs were manufactured in 2021, including: • the 10th digit of the serial number indicated the date of manufacture (i.e. M=2021) • the MEWPs were originally purchased by an Ontario-based firm in 2021 and were returned to XCMG Canada Ltd by the Ontario-based firm in 2023 • the invoices for purchasing these MEWPs in 2024 and 2025 noted the year of manufacture is 2021 This investigation determined the original serial plates on XCMG XG4047DC MEWPs owned, leased, or sold by the employer have been modified, contrary to the manufacturer's instructions, safe work practices, and the applicable CSA or ANSI standards (see order #1). Modifying information on the manufacturer’s original serial plate may: • remove relevant information about the first 3 years the MEWP was in service; • result in inaccurate service, inspection, and maintenance records; • affect the equipment inspections specified by CSA B354.7-17 Clause 5.2.6DV.2; and • affect the replacement of components that are required to be changed on a specific interval (e.g. hydraulic components are to be replaced every 2 years, according to XCMG's manual). Pursuant to section 89(2) of the Workers Compensation Act, ANT Rentals Ltd must stop supplying XCMG XG4047DC MEWPs (see order #2). If you have any questions regarding this report, please contact me for clarification or assistance. Orders/Items - Full Details Order/Item No.1 o Status: Outstanding Cited: OHS4.3(4)(c) ANT Rentals Ltd owns, sells, leases, and supplies XCMG XG4047DC MEWPs. According to the manufacturer, XCMG will not replace or reissue any serial plates unless there are significant upgrades, re-manufacturing, re-builds, or re-certification matters that require such replacement or reissuance. If a new serial plate is issued, XCMG requires the new plate containing supplementary information to be added alongside the original plate. CSA standard B354.6:17 requires a manufacturer’s serial plate to be permanently attached to a mobile elevating work platform (MEWP). Serial plates contain information about a machine's safe operating parameters, mass, serial number, and year of manufacture. The information on a serial plate must not be altered or modified. ANT Rentals Ltd representatives stated the original serial plates on twenty-seven (27) XCMG XG4047DC MEWPs have been replaced, which is contrary to the manufacturer's instructions, safe work practices, and the applicable CSA or ANSI standards. This is in contravention of the Occupational Health and Safety Regulation Section 4.3(4)(c). Unless otherwise specified by the Occupational Health and Safety Regulation, any modification of a tool, machine or piece of equipment must be carried out in accordance with (a) the manufacturer's instructions, if available, (b) safe work practices, and (c) the requirements of the Occupational Health and Safety Regulation. Measures to Ensure Compliance: NOTE: A stop supply order has been issued (see order #2) for the employer's XG4047DC MEWPs. The stop supply order will be cancelled when ANT Rentals Ltd provides WorkSafeBC with evidence that all XG4047DC MEWPs in their fleet meet the applicable CSA or ANSI standard in effect at the time the equipment was manufactured, and are safe and comply with Part 2 of the Workers Compensation Act and the regulations. ANT Rentals Ltd must ensure that any modifications required to bring this equipment into compliance (e.g. compliant serial plates, inspections, testing, etc.) are carried out in accordance with the manufacturer's instructions and the applicabble CSA or ANSI standards (e.g. no modifications without the manufacturer's prior witten approval). Order/Item No.2 o Status: Outstanding Cited: WCA89(2) Based upon the violation cited in this inspection report, the Board has reasonable grounds to believe that a thing that is being supplied is either not in safe operating condition, or does not comply with this Part or the regulations. Pursuant to section 89(2) of the Workers Compensation Act, ANT Rentals Ltd is ordered to immediately stop supplying XCMG XG4047DC mobile elevating work platforms (MEWPs).
