Please note this IR is specific to the employer's Genie equipment. Findings related to other equipment brands will be documented in separate reports. To investigate allegations related to the employer's Genie equipment, I have obtained and analyzed relevant records and information, inspected the employer's equipment, and liaised with and/or interviewed personnel who had information relevant to this matter. I have also obtained and analyzed information provided by the manufacturer. ANT Rentals Ltd provided information to WorkSafeBC about 27 Genie MEWPs in their fleet of equipment (see IR202616635988A). This investigation determined 18 of these MEWPs do not meet the applicable CSA or ANSI standard (see order #1). Pursuant to section 89(2) of the Workers Compensation Act, ANT Rentals Ltd must stop supplying Genie MEWPs that do not meet the applicable CSA or ANSI standard (see order #2). OHS Penalty & Due Diligence According to policy item P2-95-1, WorkSafeBC must consider a financial penalty if an employer has intentionally committed the violation. WorkSafeBC will not impose this financial penalty if the employer establishes that it exercised due diligence to prevent the failure, non-compliance, or conditions to which this penalty relates. Please refer to the letter that accompanied this IR in the mail for additional information regarding due diligence, how to submit information to WorkSafeBC, and timeframe for submitting evidence of due diligence. If you have any questions regarding this report, please contact me for clarification or assistance. Orders/Items - Full Details Order/Item No.1 £ Status: Outstanding Cited: OHS13.2(1)(a) ANT Rentals Ltd owns, leases, and supplies Genie equipment. Information provided by the manufacturer shows that 18 Genie MEWPs in the employer's fleet of equipment do not the applicable CSA or ANSI standard, including the following models: S-125XC, S-85XC, S-65XC, S-60, and GS-2646. Serial plates on at least 7 of the employer's Genie MEWPs note the machines comply with ANSI A92.20 and CSA B354.6. However, evidence obtained through this investigation indicates the manufacturer's original serial plates were altered or replaced, including: - the serial plates have an error in the ANSI/SIA standard referenced - the Scaffold Industry Association (SIA) changed its name in 2011 to the Scaffold & Access Industry Association (SAIA) - the serial plates have an error in the imperial unit of force listed (i.e. lbs instead of lbf) - the serial plate on S85XCD-2215 shows signs of heat damage, which is unexpected given the protected location of the plate inside the control compartment - the serial number S85CXD-2180 listed on the serial plate for this MEWP is incorrect - the letters C and X are in the wrong order - the serial plate on GS46D-GS28293 shows an outline of the previous serial plate and evidence of scraping, which is unexpected given the vertical orientation of this plate - the information on serial plate GS46D-GS28293 is significantly different from the information on the manufacturer's original serial plate Additionally, the information on serial plate GS46D-GS28293 is misleading, incorrect, and unsafe if workers followed the information while operating the MEWP outdoors. This is in contravention of the Occupational Health and Safety Regulation Section 13.2(1)(a). A ladder, window cleaner's belt or work platform must meet and be used in accordance with the applicable CSA or ANSI standard in effect when the equipment or structure was manufactured, except as otherwise determined by the Board Measures to Ensure Compliance: NOTE: A stop supply order has been issued (see order #2) for the employer's Genie MEWPs that do not meet the applicable CSA or ANSI standard. The stop supply order will be cancelled when ANT Rentals Ltd provides WorkSafeBC with evidence that all Genie MEWPs in their fleet meet the applicable CSA or ANSI standard in effect at the time the equipment was manufactured, and are safe and comply with Part 2 of the Workers Compensation Act and the regulations. ANT Rentals Ltd must ensure that any modifications required to bring this equipment into compliance (e.g. compliant serial plates, inspections, testing, etc.) are carried out in accordance with the manufacturer's instructions and the applicabble CSA or ANSI standards (e.g. no modifications without the manufacturer's prior witten approval).
