Putevi and Jedinstvo crane-sale judgment, ECLI:NL:RBROT:2013:5327

Buyers’ nonconformity/rescission claims rejected
In a sale of six 2007 XCMG cranes, five identified as QY25K4, the court rejected buyers’ rescission/refund claims concerning new/unused status and CE certification. It interpreted the agreed terms and the buyers’ knowledge; reasonable expert costs were awarded to the seller.
Outcome and response
Buyers’ main claims dismissed; some seller counterclaims allowed. XCMG was the brand, not a litigant.
No CE certification was established. Quality/corrosion statements in paragraph 4.7 were treated as undisputed between those parties; they are not an independent model-wide defect study. The safety discussion in 4.11 is case-specific. No later appeal status checked.
Original official XML retrieved through the court content endpoint. Model/facts paragraph 2.1, assessment 4.6–4.19 and operative 5.1–5.8 read; litigation context and source metadata checked.
