Read record, response & limits
Disputed plaintiff allegations — no merits finding
LTR alleges an XC968U lost hydraulic power and displayed system warnings during a demonstration (para.44). Paragraph 61(c) alleges hydraulic/control faults and other problems in XC968U/XC938U loaders, including an XC968U boom-pin bushing crack and XC968U planetary-gear overheating. These are plaintiff allegations, not findings.
Outcome and response
The pleading recounts XCMG's denial that the equipment was defective and its attribution of problems to LTR (para.72 and para.107(b)–(c)). This is the plaintiffs' account of the defendants' position, not a separately reviewed defence. No merits outcome or damages award has been reviewed.
Unauthenticated user-supplied copy of claim 2603-07923, not a technical finding or proof of defective models. No supporting exhibits, testing, separately reviewed defence or subsequent orders were reviewed. No fleet-wide inference; adjacent financing/year tables do not extend these mechanical allegations to other labels. This does not validate the separate unread Artic affidavit.
October 7, 2026 visual cross-check of actual supplied PDF pages 9, 13 and 14 for the exact model allegations; denial passages checked in extracted text at PDF p.17 para.72 and p.26 para.107(b)–(c). Verification concerns what the pleading says, not the truth of its allegations or registry status. Original file unchanged.
