Where the record stands
The March 11, 2026 order was made without notice. On September 4, 2026 Justice Crerar, again without notice, found prima facie breaches of the March 11 and March 25 orders and entered a replacement order: XCMG America Financial added, spending up to C$1.5 million a month, C$10 million total security, sale-price limits, no transfers to XCMG China affiliates and twice-monthly reporting. The order runs to a November 23–27, 2026 return date, with a November 3 hearing to settle terms. Later variation, appeal and final disposition have not been reviewed. Security is not damages awarded or an express asset-value cap. Sources: [3] [4] [6] [5] ¶

What remains unestablished
Truth of the pleaded misconduct, final liability, damages awarded, or continuing effect after the November 2026 return date. The March 11 Wild Timber order is a different proceeding from Artic’s separately reported freezing order, whose March 25/March 26 source-date discrepancy remains unresolved. ¶
The chronology
Registry seal on supplied notice of civil claim.
Entered interim asset order; business and legal expense exceptions and C$32,456,992 security provision. ¶
Replacement order entered: C$10 million total security, XCMG America Financial added, new spending, sale and reporting terms; oral reasons find prima facie breaches. ¶
The next verification
Obtain the November 3 and November 23–27 outcomes, any formalized March 25 order, appeals and the final disposition. The Artic S-261878 matter is separate. ¶

Wild Timber proceeding — entered Mareva order
Unchanged user-supplied court copy; registry authentication pending.
Used for / context: PDF pp.1–4 operative order; p.6 Schedule A
Review limits: User-supplied March 11 entered copy; not independently registry-authenticated. The October 1 trustee report (S051 para.24) reports that the related S-260999 order was extended, varied and replaced on September 4, including additional C$5 million trust security. The September 4 replacement order has since been supplied as D010; it is not part of the March original. The March C$32,456,992 amount is security that ends that injunction, not damages awarded or an express asset-value cap. Operative restrictions specifically named XCMG Canada Ltd. The order did not decide the pleaded misconduct allegations. Schedule B is referenced but appears absent from the supplied six-page copy.

Artic Machinery Ltd: Proposal Trustee's Fifth Report to Court
Published by Crowe MacKay & Company Ltd., Proposal Trustee.
Used for / context: Fifth Report para.24 (related-action order); paras.25–28 (proposal dates/hearing), 59–66 (recommendation/opposition)
Review limits: Original downloaded via trustee browser link; main report pages 1–18 fully reviewed, selected relevant pages visually inspected; appendices selectively reviewed. Paras 9–13, 22–28, 38–43, 44–52, 59–66; pages 6, 10–11, 17–18. Trustee report is primary evidence of its report and recommendation; it is not the underlying September 4 order or a court ruling approving the proposal. Paras 32–35 explain reliance on unaudited company information. XCMG opposition is recorded fairly in paras 59–61 and its April 29 counsel letter appendix F. No October 7 result yet exists as of this review. Additionally reviewed company proposal Schedule A, actual PDF pp.103–104 (printed pp.22–23): equipment, warranty and serial-year allegations, with the explicit statement that XCMG disputes the claim and intends to defend. No exact models are stated in that schedule.

Wild Timber proceeding: September 4 oral reasons of Justice Crerar
Unchanged user-supplied court copy; registry authentication pending.
Used for / context: Oral reasons paras. 9–21
Review limits: User-supplied copy received 15 October 2026; not independently authenticated against the court registry. Six-page transcript of oral reasons with text layer. The application was heard without notice and the defendants did not appear; the court describes the evidence as prima facie only. Paragraph 11 says the defendants brought the application, while the entered order (D010) records it as the plaintiffs’ application; read the two together. The transcriber replaced “$5,000” and “$10,000” with “$5 million” and “$10 million” by agreement of counsel and the judge (D011). No final liability, damages award or ruling on the pleaded fraud is made.

Wild Timber proceeding: September 4 order replacing the Mareva relief
Unchanged user-supplied court copy; registry authentication pending.
Used for / context: Order paras. 1–14
Review limits: User-supplied copy received 15 October 2026; not independently authenticated against the court registry. Five scanned pages read visually and by OCR; handwritten words checked against the page images. Paragraph 4 refers to “the order of March 11, 2025”, an apparent typographical error for March 11, 2026. The order is expressed to remain in force to the November 23–27, 2026 return date unless varied or discharged; any later variation, discharge or appeal has not been reviewed. Security is not damages and the order does not decide the pleaded misconduct.
