THE CASE DASHBOARD
Read the account and the limits
Compare up to three published matters. Classification and status text are retained from the reviewed article; this dashboard does not infer a definitive live procedural status.
In plain language: Read the claim, the response and the outcome together. A claim is what someone says happened; it is not automatically a court finding. Open the original record to check the details.
What do these terms mean?
Allegation or pleading
What a party claims. It has not necessarily been accepted by a court.
Defence or response
The other party’s position. Read it beside the claim.
Procedural step
Something that happened in the case, not necessarily a decision about who was right.
Judgment or order
A court decision. Its scope, date and any later appeal still matter.
Edition reviewed 2026-10-21. Records include disputes, regulatory measures and reported concerns; they are not all court cases.
Selected matters
Scroll horizontally on smaller screens. These records are juxtaposed for reading, not treated as a common misconduct finding.
Artic’s March 13, 2026 claim in S-261878 alleges equipment defects, unpaid warranty support and serial-plate misrepresentations. The allegations have not been determined in the supplied records.
Current account, response and reading limits
Recorded status
The trustee page lists a proposal hearing for 2026-10-07 at 10:00; timezone is not explicitly given. That is a proposal hearing, not a trial of equipment allegations. The Fifth Report records execution of the amended proposal on September 29, inspector approval September 30 and OSB filing October 1. The sanction application and XCMG voting-claim appeal were scheduled for October 7; As of October 18, no result is posted: Proceedings.ca still lists October 1 as the last activity, and the trustee page could not be read. On October 16, XCMG Canada told Global News that Artic Machinery bought about $18 million in inventory it did not pay for; Ryan Martin said the loan demand was retaliation. Neither statement is a finding.
Response or opposing position
An April 29, 2026 letter from Cassels Brock & Blackwell LLP, acting for XCMG Canada Ltd., states that the defined XCMG Defendants deny Artic’s allegations. Counsel confirms XCMG Canada’s position that its secured and unsecured claims are supported by documentary evidence, and describes the other defined defendants’ position as its understanding. Counsel also disputes the proposed equipment consideration and raises objections to the treatment of secured and contingent claims (S051, Appendix F, actual PDF pp.146–149; letter pp.1–4). These are counsel’s positions, not findings that the claims or objections are correct. Schedule A of the company’s exhibited proposal separately records that the defined defendants dispute the claim and intend to defend it (S051, actual PDF pp.103–104; printed pp.22–23). XCMG entities seek reversal of rejection of their voting claims; the trustee opposes. The Fifth Report describes XCMG’s opposition to sanction on voting and funding grounds, and the trustee’s view that implementation remains achievable but is not certain and depends on continued financing (S051, actual PDF pp.15–18, paras.59–66). These positions are not a ruling on the equipment allegations. The claim itself recounts XCMG Canada’s March 4, 2025 process-error explanation for conflicting manufacture-year plates (D004, paras.68–69); the underlying memorandum is not attached.
Not established
Equipment defect, fraud, causation of insolvency or a C$32.5 million damages award. A freezing order is interim preservation, not awarded compensation.
Review scope

Next research
Obtain defences, the separate Artic freezing order to resolve the March 25/March 26 source-date discrepancy, and the October 7 proposal disposition. Reading coverage is partial; the newly read Fifth Report passages and counsel letter do not establish a complete docket or full-source review.
The March 11 order imposed interim restrictions on XCMG Canada’s Canadian assets in VLC-S-S-260999; plaintiffs’ allegations remain unproven. A September 4 order (D010) extended, varied and replaced that relief and raised total security to C$10 million.
Current account, response and reading limits
Recorded status
The March 11, 2026 order was made without notice. On September 4, 2026 Justice Crerar, again without notice, found prima facie breaches of the March 11 and March 25 orders and entered a replacement order: XCMG America Financial added, spending up to C$1.5 million a month, C$10 million total security, sale-price limits, no transfers to XCMG China affiliates and twice-monthly reporting. The order runs to a November 23–27, 2026 return date, with a November 3 hearing to settle terms. Later variation, appeal and final disposition have not been reviewed. Security is not damages awarded or an express asset-value cap.
Response or opposing position
Public response not located; response not requested.
Not established
Truth of the pleaded misconduct, final liability, damages awarded, or continuing effect after the November 2026 return date. The March 11 Wild Timber order is a different proceeding from Artic’s separately reported freezing order, whose March 25/March 26 source-date discrepancy remains unresolved.
Review scope
Supplied stamped/signed documents reviewed alongside the earlier counsel announcement; no complete live court docket certified.

Current account, response and reading limits

On October 16, 2026, Global News reported that RCMP K Division confirmed its auto theft unit carried out the April warrant and that the investigation is ongoing; no charges are reported.
Response or opposing position
XCMG Canada said it was cooperating and lacked visibility into the scope. CityNews quoted the company describing a commercial dispute over outstanding financial obligations and saying there was no judgment, liability finding or damages award against it.
Not established

In this proceeding XCMG North America is the plaintiff and CanLift the defendant.
Current account, response and reading limits
Recorded status
The September 15, 2026 order found June 4 service proper. On September 29 CanLift filed an answer denying the claims and counterclaims against XCMG North America and XCMG America Financial (D016); a summons to XCMG America Financial issued October 5 (D017). The contract merits and counterclaims are undecided.
Response or opposing position
CanLift’s September 29 answer (D016) denies XCMG North America’s claims and counterclaims for breach of contract, misrepresentation, deceptive trade practices and breach of warranty, alleging defects, refused parts and serial-plate tampering. These are unproven allegations; XCMG’s reply to the counterclaims has not been reviewed and no response was requested. The supplied Ontario claim CV-25-00092151-0000 records CanLift’s separate position. Its $20 million damages request is conditional on invalidating the distributor arbitration clause; it is not an award or an outcome of this Nevada case.
Not established
Manufacturer misconduct or an outcome on the contract merits; equivalence with CanLift’s separate Ontario allegations.
Review scope
Public source and outcome searches; no complete live docket certified.
Next research

Current account, response and reading limits
Recorded status
For the April 2024–March 2025 review, July 2026 preliminary results denied separate-rate treatment to XCMG I&E. The existing 165.14% China-wide rate would apply to reviewed entries if final results retain that treatment. A separate 2023 subsidy review lists a preliminary 36.49% rate for the Xuzhou entries.
Response or opposing position
The amended final notice followed a trade-court remand. Preliminary notices allow further review before final results; they do not establish a final replacement rate.
